Terms and Conditions of Entry

It is a requirement of entry that all swimmers conduct themselves in a good sports like manner at all times. This is a community ocean swim offering swimmers the opportunity to participate in an amazing journey swim from Bondi to Bronte beaches. While some prizes may be awarded to those who have the fastest swim time in their respective categories, we ask all participants to remember that this is not an Event where we permit poor sportsman ship behaviour.

Bronte Surf Life Saving Club plan, organise and execute this Event each year to support its service of volunteer lifesaving. The volunteers who assist on the day do so because of the wonderful experience achieved through supporting the ocean swimming community and Bronte Surf Life Saving Club.

We hope that all swimmers are able to have a wonderful experience at this Event and we thank all persons involved for making this ocean swim one of the best around the world.

Risk Management

The Bondi to Bronte Ocean Swim and Junior Ocean Swim (now called the "Event") has a team of volunteers and paid personnel who assist with the preparation and running of the swim. There is a committee of key personnel who meet to decide on how the Event should be run based on industry best practice and risk management protocols. Bronte Surf Life Saving Club (BSLSC) obtains Event insurance for this Event under the umbrella of Surf Life Saving New South Wales and as such must meet their requirements for conducting Events. BSLSC must also meet the requirements of local council and maritime with all three entities providing approval to conduct this Event.

BSLSC risk management practices cover the many activities which occur on the day, with planning to manage identified, potential Events. These Events include but are not limited to:

  • Water safety
  • Volunteers
  • Water station
  • First Aid
  • Condition assessment
  • Evacuation
  • Search & Rescue

The Event committee are responsible for ensuring each activity on the day is conducted in accordance with our planned operations. Ultimately BSLSC want to ensure all persons involved in the Event have a great experience without harm or injury occurring.

Water Safety

On the day of the Event there will be a water safety briefing for all water safety personnel involved. This water safety briefing includes swimmer drop off, incident management and communications.

Based on water safety ratio requirements set out by Surf Life Saving, the Event meets these guidelines and exceeds the recommended water safety numbers. The Event is known for it’s water safety personnel as many swimmers provide wonderful reviews stating their thanks for the water safety team.

On the day, we will have the following water safety in place:

  • Rescue boats (inflatable and other)
  • Lifeguard operated jet ski's with mats
  • Rescue Boards
  • Surf Skis
  • Rescue Tubes
  • Elevated spotters
  • Drones (when approved)

If any swimmer is struggling and requires assistance, we ask that an arm is raised and the swimmer remains calm as we respond to the request.

If another swimmer identifies a person in need of assistance, we ask that each swimmer makes themselves available to signal for assistance in an attempt to help us identify any persons in need of help.

The water safety team will identify any request for assistance as quickly as we can and we will get assistance to that person as soon as practical.

It is a requirement that all swimmers follow the direction of water safety as we conduct this event with yours and everyone involved best interest in mind.

Safety and Risk Warning (Section 5M Civil Liability Act 2002)

All swimmers intending to swim in this Event must agree to abide by the following safety and risk warning statement.

Surf boats, surf ski paddlers and other support craft will be patrolling the course for the duration of the Bondi to Bronte Ocean Swim (hereafter called the ”Event”). If a swimmer feels unable to go on, they should attract the attention of the water safety personnel. DO NOT PANIC, remain stationary, raise your arm and wait for assistance. A swimmer deemed incapable of completing the course will be brought onto one of the support vessels by the water safety team and transported to shore. However, please note that your safety cannot be guaranteed.

Warning is given to all entrants that this is a demanding ocean swim Event. Obvious risks include and are not limited to the following: injury and/or drowning, due to being hit by other persons, objects, boats or vessels. Other obvious risks include, cold weather and water, entry and exit injuries, stings, sandbars, medical conditions and marine life.

Swimmers enter at their own risk and are responsible for their own physical condition. Any swimmer who has not passed the halfway point off South Bondi Headland within 45 minutes of the last age category wave will be removed from the Event and transported to shore.

This is not only for the safety of all swimmers but it is also for the safety of our water safety team.

Any swimmer who does pull out of the Event must notify Event officials immediately and return the ankle strap timing chip. Failure to return the timing bracelet will result in a fee of $50. If you withdraw from the Event and need transport to Bronte Beach, the Event organisers have supplied a shuttle bus which is located at the security bag drop location behind the Bondi Pavilion.

Prior to starting your swim, you must cross over the timing mats which are located on the beach. Failure to cross these mats will result in no timed swim. The mats are located between the barriers on the beach, at the starting area, identified by the flags on the beach.

While in the water, all swimmers must comply with the directions of lifeguards and/or the water safety team, if you fail to do so you will be disqualified from the Event.

It is the responsibility of the swimmer to inform themselves of the beach and water conditions on the day prior to participating in the Event

Wetsuit Policy

First and foremost, our responsibility to is to ensure the safety and comfort of all swim participants and our Water Safety Team. Equally, we want every single person to enjoy their swim experience.

The Bondi to Bronte is an early season event and water temperatures and surf conditions can vary significantly year on year. Swell direction can keep people in the water longer than their average 2km swim, which in turn keeps our water safety team in the water longer.

We have a clearly defined wetsuit policy that enables all swimmers to decide whether to wear a wetsuit on the day dependant on conditions. The policy allows for participants to have a fair and equitable opportunity to win prizes if that is a priority for them.

We provide a complimentary bag transport service from Bondi to Bronte for all participants, so feel free to bring your wetsuit and make the decision once you are at Bondi.

In short our policy is as follows and is based on the water temperature taken by Waverley Council Lifeguards at 6am on race day at both Bondi Beach and Bronte Beach:

Water Temperature =18C and above: First and second prize in each age category is awarded to non-wetsuit wearers. An overall first and second prize is allocated to the 1st and 2nd placed male and female wetsuit wearer regardless of age category (excluding Elite see below), prizes are not allocated for each age category for wetsuit wearers.

Water Temperature below 18C: All participants will be strongly encouraged to wear a wetsuit, first and second prize will be awarded for each age group to the first and second person that crosses the line regardless of wetsuit status.

We know wetsuit allowance levels/temps are contentious.

Our event Timing partner, will list results split by non-wetsuits and wetsuits. Swimmers will be separated as they cross the finish line into wetsuits and non-wetsuits.

Elite Division Swimwear Policy:

The Event adopts the following policy in regards to swimwear for competitors in the Elite Division only.
For water temperature = or > 18C BL8 (By Laws as approved by the FINA Bureau on August 5, 2016)
We permit all FINA Approved pool* swimwear per the following By Law.

BL8 - BL8.3 for pool swimming competitions*
Swimsuits for men shall not extend above the navel or below the knee, and for women, shall not cover the neck, or extend past the shoulder, nor below the knee. All swimsuits shall be made from textile materials.

For water temperature less than 18C on race day wetsuits are permitted for elite division entrants and strongly encouraged for all participants.

*while the Event is an openwater course, we do not follow the FINA openwater policy on wetsuits for water temperature above 18C.

The policies and procedures to raise a complaint and dispute must be completed as follows:

  1. Each complaint/dispute must be submitted in writing to the Race Director within 45min of the swim for consideration.
  2. Each complain/dispute will be dealt with by the Race Director of the Bondi to Bronte Ocean Swim and the Bronte Surf Life Saving Club Event Committee.

Insurance

Bronte Surf Life Saving Club Inc. is covered by its own public liability insurance. This does not include personal accident insurance. It is strongly recommended that you take out your own personal accident and ambulance cover for the Event. Your private health insurance policy may include this, however you will need to check this specifically with your private health insurer.

Waiver and Indemnity

THIS IS A DANGEROUS RECREATIONAL ACTIVITY AND YOU ENTER AT YOUR OWN RISK.

There are numerous obvious risks to participating in the Bondi to Bronte Ocean Swim.

Obvious risks include and are not limited to the following: injury and/or drowning, due to being hit by other persons, objects or boats. Other obvious risks include, cold weather and water, entry and exit injuries, stings, sandbars, medical conditions and marine life. Each swimmer must be a competent ocean/surf swimmer to participate in this Event.

Each swimmer will be required to wear an Event timing chip bracelet.

Officials maintain the right to reject or refuse any entry.

Medical officers commissioned by Bronte SLSC have the authority to remove a competitor from the swim without reason.

All swimmers must be unaided; eg no flippers, wet suits, boards, or any other floating gear is permitted except for the 'Families, Flippers Wetsuits and Floaties' category. All swimmers must swim the prescribed course.

All swimmers are to wear their prescribed cap and timing bracelet.

The decisions of the Race Director are final. All swimmers are to behave in a sportsman like manner.

Disclaimer

I hereby waive release and discharge all and every claim, right or cause of action (including for negligence, for breach of contract or breach of Statute) for which I might have or which arises out of my death, injury, damage or loss of any description which I may suffer or sustain as the result of my participation in the Event.

This waiver release and discharge shall operate jointly and severally in favour of the Indemnified Parties, namely: Macquarie, Banana Boat, Bronte Surf Life Saving Club, Everyday Hero Pty Ltd, New South Wales Maritime Authority, Waverley Municipal Council, the Surf Life Saving Association of Australia (and any of its State Centres, Branches, affiliated Surf Live Saving Clubs and Committees), sponsors, supporters, persons, corporations, contractors, sub-contractors, volunteers, servants and employees involved or otherwise engaged in organising, promoting, staging, administering, running or controlling the Event.

I agree to indemnify and keep indemnified the indemnified parties against all actions, suits, demands, claims, proceedings, costs, expenses, liabilities and judgments (including for negligence, breach of contract or breach of statute) arising out of or in relation to my participation in the Event. This indemnity may be pleaded as a bar to any action, claim, demand, suit or legal proceedings.

I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered discretion of Event Medical personnel and Lifesavers in the event of any injury accident or illness to me as the result of my participation in the Event.

I consent to the free use of my name, personal information, photograph, interview or appearance in any newspaper, promotion, advertising material, publication, video, broadcast, website or use in any media now known or yet to be devised, by the Event and/or its sponsors.

I affirm that I have properly trained for and fully satisfied myself as to my physical and medical condition to compete in the Event.

I agree to abide by and accept the rules and regulation of the Event whether announced on the day or prior thereto and to accept the decisions of both the Race Director and the Race Committee.

I agree and accept that the Event Committee may, at its absolute discretion, vary the rules and regulations of the Event and without prior notice to me.

I agree to accept full responsibility to inform myself and assess all the dangers hazards and risks of entry in the Event and rely solely on my own assessment of these dangers, hazards and risks before participating in the Event and notwithstanding any decision thereon made by the race committee and other persons corporations and bodies involved engaged in promoting or staging the Event.

I agree that in the Event of cancellation of the Event my entry fee shall not be refundable.

I agree that as a person to whom recreational services are supplied by the organisers, it is a term of my entry that I engage in the recreational activity of the Event at my own risk.

I agree that the terms and conditions contained in this entry form shall be construed broadly to provide a release, indemnity and waiver to the Indemnified Parties of any liability for loss injury or other damage to personal property to the maximum extent permitted by law.

The Event reserves the right to recoup from the participant any costs associated with a Search & Rescue if that participant has failed to notify officials that they have withdrawn from the Event.

Indemnity in respect of persons under 18 years

In consideration of the Event agreeing at my request to accept the entry of the minor applicant I agree for myself, my heirs, executors and administrators to indemnify and keep indemnified the Indemnified Parties against all actions, suits, claims, proceedings, demands, cost, expenses, liabilities or judgments which the applicant and I may have against the Indemnified Parties but for the terms of this agreement in respect of any death, injury, damage or loss sustained by the minor applicant as the result of the minor applicant's participation in the Event. I affirm that I have full authority on behalf of both Parents and/or Guardian to sign this indemnity AND that this indemnity may be pleaded as a bar to any action claim demand suit or legal proceedings.

Refund Policy

THE BONDI TO BRONTE OCEAN SWIM IS SUBJECT TO WEATHER CONDITIONS ON THE DAY. IF THE CONDITIONS ARE ASSESSED TO BE TOO DANGEROUS FOR THE EVENT TO PROCEED, THERE WILL BE NO RE-RUN OF THE EVENT AND ENTRIES WILL NOT BE REFUNDABLE. THE PROCEEDS FROM THE SWIM ARE DONATED TO BRONTE SURF LIFE SAVING CLUB FOR THE SUPPLY OF VOLUNTEER LIFESAVING SERVICES.

The Event policies and management practices ensures high professional standards in the delivery of the Event are maintained, whilst prioritising safety and reducing hazards to swimmers and personnel involved in the Event.

Refund conditions:

Participants must contact the Event organisers more than five (5) working days prior to the Event date outlining their request to cancel their entry. Registration fee less 5% will be refunded to cover bank fees and admin charges.

Any Event participant who withdraws from the Event within five (5) working days of the Event date no refund will be payable.

Dispute Resolution - Event Results and Sportsmanship

The Event will ensure that all competitors have access to a fair and equitable process in dealing with grievance and provide an avenue for competitors to affect their final position.

The policies and procedures to raise a complaint and dispute must be completed as follows:

Each complaint/dispute must be submitted in writing to the Race Director within 45min of the swim for consideration.

Each complain/dispute will be dealt with by the Race Director of the Bondi to Bronte Ocean Swim and the Bronte Surf Life Saving Club Event Committee.

Privacy Policy

The Bondi to Bronte Ocean Swim respects your ability to make informed choices about the collection and use of your personal information. The Event respects your right to privacy and we are bound by National Privacy Principles in the Privacy Act. We use personal information collected from competitors to inform them of competition details or advance notice of competitions. We consider that information provided by you to us is sensitive and deserves to be handled with the utmost care. For this reason, all files are strictly confidential and all information is classified.
